बिना लिखित अनुमति के संपत्ति विरूपित करने पर एक हजार रूपये का जुर्माना jurmana Aaj Tak 24 News 

बडवानी - कलेक्टर एवं जिला निर्वाचन अधिकारी डॉ. राहुल फटिंग ने मध्यप्रदेश संपत्ति विरूपण अधिनियम के तहत प्रतिबंधात्मक आदेश जारी किये है। उन्होने आदेश में स्पष्ट किया है कि चुनाव प्रक्रिया के दौरान विभिन्न राजनैतिक दल या चुनाव लड़ने वाले अभ्यर्थी या विज्ञापन कम्पनियां किसी भी शासकीय/अशासकीय संपत्ति को सम्बन्धित विभाग या भवन स्वामी की अनुमति के बिना विरूपित करती है या संपत्ति को स्याही, खड़िया रंग या किसी अन्य पदार्थ से लिखकर या चिन्हित करके विरूपित करती है तो वह जुर्माने से जो 1 हजार रुपये तक का हो सकेगा दण्डनीय होगा। ऐसा किये जाने पर सम्बन्धित विभाग या भवन स्वामी के द्वारा संपत्ति विरूपण बावत थाने में प्रथम सूचना दर्ज करायी जा सकेगी । थाना प्रभारी संबंधित प्रथम सूचना रिपोर्ट के आधार पर विधिवत जांच कर सक्षम न्यायालय में चालान प्रस्तुत करेगा। जिला निर्वाचन अधिकारी डॉ. राहुल फटिंग ने यह आदेश लोकसभा निर्वाचन को स्वतंत्र, निष्पक्ष व शांतिपूर्ण ढंग से सम्पन्न कराने के मकसद से जारी किए हैं। उल्लेखनीय है कि मध्यप्रदेश संपत्ति विरूपण अधिनियम 1994 धारा 3 के अन्तर्गत जो कोई भी व्यक्ति या राजनैतिक दल या उम्मीदवार शासकीय भवन या कोई भी संपत्ति के स्वामी की लिखित अनुमति के बिना संपत्ति का विरूपण करेगा तो उसके खिलाफ एक हजार रूपये तक का जुर्माना होगा। इस अधिनियम के तहत दण्डनीय कोई भी अपराध संज्ञेय होगा।

Fine of one thousand rupees for defacing property without written permission

Barwani - Collector and District Election Officer Dr. Rahul Phating has issued restrictive orders under the Madhya Pradesh Defacement of Property Act. They have clarified in the order that during the election process, various political parties or contesting candidates or advertising companies deface any government/non-government property without the permission of the concerned department or building owner or deface the property with ink, chalk or any other material. If someone defaces it by writing or marking it with any other substance, he will be punishable with a fine which may extend to Rs 1,000. Once this is done, the first information regarding defacement of property can be lodged in the police station by the concerned department or the building owner. On the basis of the concerned first information report, the station in-charge will conduct a proper investigation and submit the challan in the competent court. District Election Officer Dr. Rahul Phating has issued this order with the aim of conducting the Lok Sabha elections in a free, fair and peaceful manner. It is noteworthy that under Section 3 of Madhya Pradesh Defacement of Property Act 1994, any person or political party or candidate who defaces a government building or any property without the written permission of the owner will be fined up to one thousand rupees. Any offense punishable under this Act will be cognizable.
